InterVideo InstantON may bundle with certain copyrighted free
software, open source programs or other public available files
or software components (but independent and separate to the
InterVideo InstantON proprietary programs and/or software) owned
or licensable by some foundation, author, organization or other
entity, which may be either disclosed or distributed in source
code form, licensed for the purpose of making derivative work,
or licensed free of charge, including but not necessarily
limited to GNU General Public License and GNU Lesser General
Public License ("FREE SOFTWARE").
Such FREE SOFTWARE, as listed in
each table for the respective versions of InterVideo InstantON
identified in the schedule below, shall be governed by and
pursuant to the limited licenses under terms and conditions in
the applicable web addresses set forth in the corresponding
schedule or otherwise introduced by InterVideo. The licenses and
terms and conditions to such FREE SOFTWARE, including any
correction or update posted by InterVideo or the relevant
foundation, author, organization or other entity in the
introduced websites, shall be binding to, accepted and fulfilled
by any user and/or licensee who uses the InterVideo InstantON or
exercises the licenses granted under the terms of the applicable
FREE SOFTWARE. InterVideo is not permitted to grant any right
and license for such FREE SOFTWARE other than the rights granted
under the applicable license terms and conditions, or to impose
any further restriction on any user or licensee for such FREE
SOFTWARE, unless is permitted according to such terms.
FURTHERMORE, THE FREE SOFTWARE IS
PROVIDED "AS IS" WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND,
EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NONINFRINGEMENT, SUBJECT TO THE TERMS AND CONDITIONS
OF THE APPLICABLE LICENSE. THE ENTIRE RISK AS TO THE ACCURACY,
QUALITY AND PERFORMANCE OF FREE SOFTWARE IS WITH YOU. SHOULD THE
FREE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL
NECESSARY SERVICING, REPAIR OR CORRECTION.
IN NO EVENT SHALL
INTERVIDEO, THE AUTHORS OR COPYRIGHT HOLDERS OF FREE SOFTWARE BE
LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, DIRECT,
INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL
(INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS
OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS
INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY,
WHETHER IN AN ACTION OF CONTRACT, STRICT LIABILITY, TORT
(INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING IN ANY WAY FROM,
OUT OF OR IN CONNECTION WITH THE FREE SOFTWARE OR THE USE OR
OTHER DEALINGS IN THE FREE SOFTWARE, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGE.
